9. Applicable Law and Venue; Dispute Resolution
To the extent you have in any manner violated or threatened to violate Consolidated Bus Transit’s intellectual property rights, Consolidated Bus Transit may seek injunctive or other appropriate relief in any state or federal court, and you consent to jurisdiction and venue in such courts.
In any dispute, NEITHER YOU NOR CONSOLIDATED BUS TRANSIT WILL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER VISITORS IN COURT OR OTHERWISE PARTICIPATE IN ANY CLAIM AS A CLASS REPRESENTATIVE OR CLASS MEMBER.
10. LIMITATION OF LIABILITY
Any cause of action or claim you may have with respect to this Site must be commenced within one (1) year after the claim or cause of action arises.
Consolidated Bus Transit reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you at your expense, and you shall not in any event settle or otherwise dispose of any matter without Consolidated Bus Transit’s prior written consent.
